President Joe Biden has called for major changes to the Supreme Court (SC), including a constitutional amendment that would limit immunity for presidents, impose term limits for justices, and stipulate an enforceable code of ethics, Swapna Venugopal Ramaswamy reported for USA Today.
Biden mulls term limits for SC justices and also wants a binding code of conduct for the SC justices.
In an op-ed in the Washington Post, Biden said "no one is above the law." He added: “Not the president of the US,” he wrote.
“Not a justice on the SC of the US. No one.”
Aamer Madhani of the Associated Press (AP) also reported that the White House is looking to tap into the growing outrage among Democrats about the court, which has a 6-3 conservative majority, issuing opinions that overturned landmark decisions on abortion rights and federal regulatory powers that stood for decades.
Biden mulls term limits for SC justices while legal experts suggest expanding the court’s membership to 13, the number of judicial circuits in the US. He also wants a binding code of conduct on the SC justices, Reuters reported.
In July, the SC ruled that presidents cannot be prosecuted for "official acts" during their time in office.
The court's ruling stemmed from a case concerning former President Donald Trump. Presidents can still be prosecuted for their unofficial criminal behavior.
“What is happening now is not normal, and it undermines the public’s confidence in the court’s decisions, including those impacting personal freedoms,” he wrote.
“We now stand in a breach.” Vice President Kamala Harris, who is running to be the Democratic presidential nominee, said in a statement Monday that she also backs the reforms as the SC faces a “clear crisis of confidence” from the American people.
